What this covers

DAnalytics measures what happens in a Discord server — messages, voice, joins and leaves, moderation, reactions, tickets — and renders it as dashboards, alerts and exports. It can also read the logs other bots already write, so a server that has been running for years is not starting from nothing.

These sit alongside the general terms of service.

Licence

DAnalytics is licensed under the Elastic License 2.0, plus one additional restriction from us: commercial use requires a business licence.

That addition is stated separately because ELv2 does not contain it. ELv2's own limitations are three — you may not provide the software to others as a hosted or managed service, may not circumvent the licence-key functionality, and may not remove or alter the licensing, copyright or other notices — and it otherwise permits a company to run the software commercially for its own internal purposes. Our additional term removes that permission.

Non-commercial use on your own infrastructure is free of charge. Commercial use of any kind, including internal use inside a business, needs a business licence from us.

Who is responsible for the server you point it at

You are. Adding DAnalytics to a Discord server makes you the controller of what it then records about the people in it. They did not agree anything with us, and in most cases we are nobody to them.

That has consequences you should take seriously before you install it:

• You need a lawful basis for measuring your members, and you need to be able to tell them what you are doing. Point them at the privacy notice — it is written for them as much as for you.
• The privacy profile you choose decides what is kept about real people. The default keeps no message content; you can change that, and if you do, that is your decision and yours to justify.
• Discord's own terms and developer policy apply to you as well, and they come from Discord rather than from us.

The privacy profile is the important setting

DAnalytics ships on the standard profile, which records message metadata — when, where, how long, how many mentions — and not message content.

You can move a guild to minimal, which additionally hashes the identity of everybody involved and drops nearly everything else, or to full, which records content and names and topics and activity in the clear. You can also override individual fields.

Two limits on that, both enforced by the software:

1. The effective setting is the strictest of the preset, your override, and the global cap set by whoever operates the instance. Nothing you set can loosen a cap above you.
2. Hashed identifiers are HMACed with a salt belonging to that guild alone, so a hash from one server cannot be matched against a hash from another.

Moving a guild to a looser profile changes what is recorded from that point on. It does not reach backwards and fill in what was dropped.

Backfill

DAnalytics can reconstruct history from a server's audit log, from a log channel another bot wrote, or from message history. Backfilled events are recorded under the profile in force at the time of the backfill.

Reaching back into a server's past is a real thing to do to the people in it. Do it deliberately.

Members can act without you

Members have a /privacy command in Discord that shows what is stored about them and lets them opt out — for your server, or for everything. An opt-out is honoured by the software, not by us on request, and you cannot switch it off for them.

They can also ask for erasure, which the software tracks as a request through to completion.

Do not use DAnalytics to defeat any of that. Doing so puts you, not us, on the wrong side of Art. 12 to 22.

Acceptable use

Beyond the general terms: do not use DAnalytics to profile individuals for harassment, to build a case against a member from surveillance they were never told about, or to sell what it records about people.

Measuring a community is a legitimate thing to want. Following a person is not the same activity, and this is not a tool for it.

If we host it

Where we run DAnalytics for you, the data processing agreement and its annex apply, and you remain the controller for your server's members.

Availability

No service level is promised unless a separate signed agreement states one. Discord's API is outside our control, and a gateway outage is a gap in the record rather than a failure of the service.

No warranty, no service level, and limited liability

This product is provided as it is and as it happens to be available, without warranty of any kind, and is used at your own risk. No uptime, response time or restoration time is owed unless a separate signed agreement states one. Where it is provided free of charge, liability is limited to intent and gross negligence (Section 521 BGB).

To the fullest extent the law permits, we are not liable for damage arising from its use, its unavailability, or any loss of data — and keeping your own backups is your responsibility. The limits that mandatory law requires, the exclusions that apply within them, and the additional cap that applies to business customers are set out in full in the general terms of service, which govern this product and are not restated here.
